If I am reading this correctly, this is only a Factum "a statement of the facts of a case". I am guessing this is what they will use as the grounds for their appeal. In my humble opinion, I would think that they have a very good argument for their appeal.

Yes you are correct & I agree. Now can they convince 3 Quebec Judges, that's the questions and if so then GREAT, if not it's onto the Supreme Court of Canada which means we as shareholders have to wait even longer for payday.
