Here's my view:
What is the most successful and profitable company in today's global economy. I think it is the company that has created patents that are capable to be adapted in industry standards as fundations. Remember only patents have these characteritics count. The characteristics of these patens can eventually lead industry to develope products with a pervasive and profound impacts on consumers: Every consumer will use the products, anywhere, anytime. When that hapens the company that holds the patents gets biggest and sustainable rewords, billions if not hundres billons as profits. (Remember most patents are no or less value becuase of lack these characteristics described above). Without these crucial patents (IP), any company (even has a great products) will soon find everyone will copy its success. And this eventually forces itself into a commodity-like company (if not force to close its business).
To be such a ideal company to stand at its final victory, one has to pass three phases of tests:
Phase I: To be able to invent patents that have distructive technology-like values; To form a company with a vision to reach its potential value.
Phase II: To develope products with superiority that can revolutionalize whole industry; To convince industry to adapt the patents into industry standards as basic fundations and vigorously apply it; To trigger huge market demands for the products based on these standards.
Phase III: To succssfully defend these patents that will generate continuous flow of income (royalty payments).
Where to find this kind of company? Here, It's wi-lan.
Win is the ideal company as I described above. It's patents now have been the fundations of the industry major wireless standards (802.11a/g, 802.16d/e). It's product superiority has led to fujitsu wimax SOC, a best product in the industry (fujitsu now is win's licensee). There are huge demands for wimax and other wireless products (fixed/mobile wimax, wi-fi, wibra, 3G etc. All based on win's IP). Win has won two cases against its infringers including cisco, an industry giant and has proved validity of its patents in the courts. Win now has started to recieve the royalty payments from fujitsu, redline, cisco and others. Because of these achievements, win now has strength and resources to win the final victory, if we put win in the control of Hatim (inventor). Remember it is hatim who made all these achivements possible.

Now Wi-lan has successfully passed two phases of tests (Phase I/II) and now at the later stage of Phase III (we are at the front door of of the final victory).
To reach the final victory (to get royalty payments from infringers worldwide ), the key question is: Can win successfully defend its patent right? The answer is a big YES! It did it before (cisco/redline cases), and will success for next one if necessary (only after warning fails). Why?
- Win has proved its patent validity in the courts via cisco(radiata)/redline cases and won these cases regarding to win's IP rights.
- The proved qualifications of win's inventors to be able to successfully defend win's IP with reqired specific knowledges, capability and experiences regarding to w-OFDM.
- Win now has about 20 millons cash. Plus continual flow of income from Fujitsu, cisco, redlines and other licensees. (Win's IP recieved about 0.50 m /Q or 2 M/year (estimate). Now Wamax, wi-fi, 3G (all based on win's IP) markets are huge and growing, so does the royalty payment from fujitsu, cisco, redline and other licensees.
-now win's inventors have passions to return to take win to its final victory.
Indeed it's a long time and a lots of pain for win to get here. But remember: It's important that we are able and lucky to stand here at the front door of final victory afer all necessory achievements. Look at other visionary and innovative companies, like Microsoft, It took more than a decade (13 years?) to reach final victory (widely accepted by the industry and the markets).
But all successes can be evaporated and turn to failure if we let the current BOD to run win. Remember it is the current BOD that run win nearly into bankruptcy because of their incompetence and suspicious motivation. We have to replace them first.
