So if I understand the letter from RH it goes something like this-

ROD/FEIS completed 7/08 and released.
45 days to appeal decision
45 more days to try and resolve the issues
Then someone is "threatening" a lawsuit for some length of time

It does appear that there is advance preparation anticipating the filing any lawsuit. That will save some time.

Now the NPDES permit. This is already in hand, but now has been modified for a mixing zone, is this finished or still under review by the State?

The ROD for the NPDES permit, there could further appeals here as well? There isn't any mention of that possibility in his letter. I count a possible 135 days after the issuance of the FEIS.
