The fiduciary responsibility is owed to the company, which is considered a legal entity itself. That means Outwaite's duty is to act in the best business interests of the company. That doesn't mean that Outwaite can't make a public statement but there is a tendency to inappropriately criticize management of companies for not doing their fiduciary duty. If you want to really understand fiduciary law, go to the Supreme Court of Canada website, do a keyword search which includes the word fiduciary and then slog through some very long and complex cases.
