Good points Yemen.

Given the scenario of higher license fees as opposed to lump sum for past infringements it would be next to impossible for Wi-LAN to have included any amount for Samsung in it's 2009 guidance. Samsung didn't sign until after 09 guidance was given. The difference in proportions between the two payment options could have been large enough so as to skew the guidance beyond acceptable tolerances and therefor left out altogether.  The increased 09 guidance may very well be in large part due to RIM and a few others.
