Intel v. Wi-LAN

Wi-LAN delivers Notice of Partial Withdrawal of Motion to Dismiss the Intel DJ proceeding to the extent such motion is predicated upon the lack of personal jurisdiction and improper venue, but maintains that this action should be dismissed for lack of subject matter jurisdiction and should be transferred to the district of the first-filed litigation between the parties concerning the same subject matter.

Wi-LAN is saying the important issue is the subject matter of the case. No need to drag all your people in to court and argue to monotony wether Wi-LAN may have talked to someone or attended a meeting in California that may constitute having done Wi-MAX business and ah ha ... personal jurisdiction ... maybe.

The important issue is wether the California court should duplicate court proceedings and judgment on Wi-MAX patents or should it be part of the Texas litigation as per Judge Ward from Tyler Texas.

I'm betting it will be transfered to Texas.
