Legal MatterThis is a brief visit to the Bullboards.
Earlier today I was informed by a colleague of a post by drillbit2008, that he copied and forwarded to me. The post has been removed by Stockhouse as being defamatory. My colleague, who has consulted me on similar matters, agreed that inappropriate comments were made. Recent events seem to have triggered a desire on the part of some posters to make references about me that, due to publicity of a legal action, are no longer of an anonymous
nature. I am informing anyone that may choose this course of action, that I will take the same action as I have initiated with drillbit2008. Details will be provided to my lawyer, and he will proceed with the action he deems appropriate. I have pasted a copy of the response received from Stockhouse related to today's postings. Just in case anyone thinks the Court Order is of any protection, I can assure you from personal experience it is not. On a less serious note, I will be personally interested in learning whether drillbit2008 is from the U.S., Australia or that Fort east of Edmonton.
Greetings and Good Luck to some of my old SH friends, and those who still pay the occasional visit by inbox.
Dear ******,
Thank you for contacting us today with your inquiry. First, I would like to inform you that our administrators do not monitor or investigate any discussion on any Bullboard. This is because the Bullboard is a public online forum. If we were to monitor the activity of every poster, we can then be held legally liable for anything and everything posted.
That is why we strongly encourage our readers to report any offending post(s) to our administrators by using the 'Report Abuse' tool located just on top of every message. This is required so that every claim submitted and every action taken on the post(s)/poster is kept on record in the case any legal issue were to arise. Be assured that we review all complaints made several times a day during regular business hours. Please be advised that only posts containing spamming, physical threats, swear words or implied swear words will be removed.
If the violation occurs multiple times the poster 's account is suspended for 7 days. After that 7 day warning, the account is then reinstated. However, if they continue to violate the Terms of Use, their account will then be suspended indefinitely.
Furthermore, another alternative you have is to take legal action on the offending user. In order to do this, we will require your legal council to contact us with a 'Court Order' requesting to have a specific post(s) removed or even to obtain the account information of a particular member of Stockhouse.
Thank you for your assistance in keeping the Bullboards free of inappropriate content. If you require further assistance, please do not hesitate to contact us again.
Sincerely yours,
