It could be that the company doesn't have to act on these preferreds unless the courts force their hand. It sounds stupid but if there is no more lawsuit, the company could be waiting till the bonds/notes that mature in a few years before they do anything with the preferreds. In the meantime, I wonder if the preferreds still accrue interest. Can you still sell preferreds if you requested them to be retracted?
