And they are attempting to invalidate a well-defined patent that stood-up to repeated scrutiny of the USPTO and claims constructions just shows how far they have backed themselves into a corner.
I have to believe the CAFC will uphold patent validity (and USPTO & lower court's credibility) and grant Wilan a settlement. Fines should also be levied against Apple IMHO.
Otherwise this case will be going to the Supreme Court, and the CAFC does not want that to happen because it will make them look like fools. The Supreme Court would throw the case out with a 'no-contest' ruling.
This case will be resolved shortly IMO. The market is thinking so too..
