Actually not a real dumb point by the lawyer. Horse racing is allowed precisely because it is horses, not human athletes. Very clear in NY state gaming law. Likewise their point about why season long was okay and daily not. Seems great until you realize all the NY AG has to do is nix season long as well. Judge may rule there are inconsistencies and order it be cleaned up. Won't necessarily lift the ban. We'll see.
