to have any chance in law...you would need an expert independent QP coming in and saying...yes that is material...versus the company QP saying, no that is not material.

Question of materiality is very subjective. 

Unless, it is blatantly obvious...no real case.

Not here. $KDI sat on valuations for a whole month before releasing them.
