Patent Concerns

Patent Concerns

After doing some research on RotoGro I found one of their Corporate Presentations noting RotoGro own a US Patent Number: US 6,840,007 B2 which was granted in the US in January 11, 2005 ... it seems like this was lodged in 2003 and covers the entire rotational garden principal ...

I also found the following published by us on YouTube: https://m.youtube.com/watch?v=d5tBqOrTTMs&feature=youtu.be ... at 58 minutes 20 seconds we imply that RQB would breach RotoGro's US Patent if we entered into the US which is obviously based on their Patent granted in 2005 ...

I am not sure how we stand on prior art given RotoGro's first US Patent was lodged in 2003 and their subsequent Patents were lodged in 2015 across the US, Canada, Europe & Australia; all prior to RQB being established and George being involved in the cannabis technology space ...

After reading RotoGro's announcement, what concerns me further is that George and Synergy purchased rotational gardens from RotoGro back in 2016 & 2017 and drafted a licensing and royalty agreement between RQB and RotoGro back in 2017 which was never entered into ...

Further, once the agreement was not entered into; RotoGro issued us with a notice of potential infringement to Patent Pending on the basis that if the Patent were awarded we would be in breach of the Patent ... to me it seems we have not been given the full background here and are again being kept in the dark while we try to find our footing to settle with RotoGro ...
