Dorsey motion to deny IBC amendments w / graph" On October 21, 2019, IBC filed its motion in this Court seeking leave to amend its complaint to assert the very same trade secret misappropriation, trademark infringement, tortious interference, unfair competition and defamation claims that Judge Scott already dismissed for lack of jurisdiction. See Proposed Amended Complaint2 attached as Exhibit D. In its motion for leave, IBC does not inform the Court of any of these facts nor does it mention that the claims it asks this Court for leave to assert have already been dismissed in Judge Scotts final order for lack of jurisdiction. Nor does IBC offer a single reason for waiting nearly ten months (and only after its claims were dismissed in state court) to bring its motion for leave. In fact, IBCs motion fails to offer any explanation or justification for its serial pleadings". ======= " IBCs fails to provide any explanation at all for the delayed allegation of these facts and claims. Instead, IBC presumes it is entitled to amend without making even the slightest of efforts to explain why the amendment complies with Rule 15". .......... I would think that's a huge, bigly no-no, to not tell the judge you're trying to make a fool out of him. ( hmmmm ).....he's done.
