I really don't understand the bickering. I cross posted in VFF - I really don't understand the bickering.
It is in both companies best interest to work this out - but the law gets involved in several disputes within companies all the time.
I'm not saying I know everything - but I have set on several boards of directors and lawyers always get involved in financial situations. Also, just because one lawyer thinks one thing is right isn't necessarily how a judge will see it.
Bottom line - lawsuits like this take time and money. If EMH defaults and is just dragging their feet because of poor management -- the deal should be restructured. Lots of firings and VFF will take control.
I haven't seen any documents regarding the conract - who owns the licence? who owns the buildings? who owns the retrofitting design and schematics? who owns the infrastructure?
If you can answer all these questions - you will have a better idea who will win - but if they renegotiate they both win bigger and don't need waste money on lawyers. The reality is that EMH is going to have to give something up here and shouldn't be stubborn about it. They both have a lot to lose.
