Critizing someone's performance or acumen is NOT defamation. It's an opinion protected by the Charter.
Correct. And had those defendants put up a defense, they would have prevailed and gotten off. The reason they were found liable is because by not responding to the lawsuit, they became subject to a default judgment.
Note: importantly, this doesn't apply to the morons who publicly accused Roger of running a "pump and dump". As the judge notes, a pump and dump is illegal, so the poster is accusing Roger of a crime. If you're gonna do that, you best have evidence to back it up. Otherwise, that's libel...even in the US, which values free speech much more highly than Canada does.
