A few errors on your post my friend. The May 28th date is requesting arbitartion for the prom. note holders (Matrix Venture Capital), I had to re-read and dig in to clear that up. No date has been set regarding arbitration on the lease agreement. As you likely know, Matrix is a company registered by Michael Barker solely.

Also, the lawsuit regarding OK falls was never served, and has actually been altered to remove the mortgage remedy. Likely a manoever, in the case of chapter 11. The OK closing dragging on has been quite pathetic, investors in the CPDM development plan must be holding back as long as possible.

From what I can ascertain, Barker wants out period and his money back plus 10%. So, around 100m. Rumours are an offer came about from a NY investment firm for around $89M but no deal. I suspect, the moves by Barker and his investors (institutional) are predatory and they are trying to bankrupt Sunniva.

Any company willing to buy GH, would have to honor the lease agreement otherwise, which was based on a $54M project cost, that now has ballooned to (90M committed  and 120M completed). So, this is coming down to longevity, as Barker sits on 90m with no prospects of any ROI, and Sunniva on the brink of existence.

The only path forward for Sunniva that I can see is a buyout of Barker and a total re-finance by the new owners, and of course the legal team (Denton's) of Sunniva has its day in court and is successful. good luck to all!!
