Why was US patent application 14/276,165 even filed in 2014 when US patent 8,895,078 already existed? 

 

14/276,165 was filed with the same claims that were approved in 8,895,078 but the resulting US patent 10,870,632 is more restrictive than 8,895,078. The supercritical extraction claims are removed entirely and the subcritical extraction pressure range was changed from 100 - 350 bar to < 70 bar.

 

So why sue GW Pharma for infringement of 10,870,632 when 8,895,078 is more encompassing?
