KND Law - Derivative Action (Vegn Cannabis Assets?)Yes, we commenced a proceeding called a "derivative action" in the Supreme Court of British Columbia on August 27, 2021. It's a little complicated because Agra is not actually the proposed defendant (i.e. we do not want to sue Agra). Instead, we are asking to represent Agra and sue 29 proposed defendants (including former CEOs Brandon Boddy and Derek Ivany, former CFOs Peter Nguyen and Christopher Cherry, former director Christopher Hornung, and so called consultants David Parry and Eugene Beukman). We are also asking to sue a number of defendants who were involved with SOW (now called Powertap Hydrogen Capital Corp). We are alleging that the 29 proposed defendants have been running a years-long conspiracy where they have siphoned off $186.2 million rightly belonging to Agraflora, without any legal justification. Their scheme is rather complicated, but it involves mainly creating fake/worthless companies owned by the 29 defendants and selling them to Agra (sometimes through other companies like SOW) for millions of dollars, as well as what we allege to be fake/worthless consulting agreements where the defendants received tens of millions of shares for no real reason. We are hoping to be able to get money back to Agra. But these lawsuits move very slowly so it could be months before I have anything of real substance to report.
