RE:Is there a lawyer in the house? Not a lawyer, but I believe the short answer is no. Either suitor needs to obtain 50% of the shares that they do not have control over. In the case of BHP and the lock-up agreement with the BOD, they could not count those as part of the required 50%.
I assume the same thing for any agreement re Wyloo shares , as they would be now under the 'control' of BHP.
Interesting times. Not quite over yet IMO.
