RE:RE:Contract dispute settled between City of Ottawa and us Right, this agreeement covers only the maintenance contract. My analysis with the minimal public information I have at hand (and my experience), is that the city will pay RTG withheld funds from the 1B maintenance contract and RTG implements a program that it should have submitted to fix all outstanding issues and the city has approved with clear tasks, deadlines and performance metrics.
The construction claims of RTG of which we are part of, against the city total 225m plus other costs like interests and the city is suing RTG for 130m.
The city is also suing its insurers to pay its costs and our claim. The total of about 355m is mostly due to the Rideau street sinkhole, a hole under the pavement due to water infiltration and seepage and poor infrastructure management by the city, that has evolved over the years, that it should have detected, known and fixed as part of a proper road management system at the city level, before singing with RTG, or requested a thorough evaluation by a third party to assess the vulnerabilities of its pavement network and soils along the subsurface alignment.
With the very little public information I have, my opinion is the wrap-up insurer (a wrap-up insurance covers most every mishap - see link below) which has been retained by the city will ultimately have to pay. The city is at fault if it did not retain a wrap-up insurer or did not require one from RTG, which would really be very amateur. Also, had the city retained an independent engineer (IE) to advise it, and it has not, and RTG needs to demonstrate that the city is at fault for not doing so because it did not have the expertise to act as owner, the IE would have required a thorough geotechnical and pavement assessment with non destructive structural evaluations conducted on the surface of Rideau street (provides deflection basin for a given load to assess the resistance to deformation of the underlying layers) followed by ground penetrating radar to detect voids. Obviously this could have been avoided... 400m+..
