IPA (Wilan) v. MicrosoftMost pre-trial motion have been ruled on by the court and the trial opens May 6th at 9:30 AM EDT in Delaware.
Motions' rulings on infringement were a mixed bag. IPA lost the 115 patent but retained the 560 patent; it looks like there is still more than enough to press the infringement assertion. However, IPA was a clear winner on damages, with the court refusing Microsoft's motions to deny alI IPA's damages experts and their reports. Microsoft has filed a motion to reconsider, as a matter of law - stating that law does not support a damages calculation in excess of $200M. Given the strength of the court's original order opinion on damage experts/reports, it is unlikely that Microsoft will succeed. The court should rule on this early next week.
Given QTRH's residual interest in Wilan and the potential size of damages (say nothing of 7 years of interest), this is an important catalyst to keep an eye on.
