hmm I think that I might have derived that statement out of implication... since I can't find an article that states that specifically.
Here is what I am thinking. Wilan's case against Radiata was dropped because product was not sold in Canada. Buy using this defence I take it as implied that they also do not plan on selling products in the future in Canada. Otherwise why use this defence?
Well I guess they could have used that defence to buy themselves more time but that would also cost them more $$$ in the long run, make them look foolish in front of the courts for trying to use timeing issues in their favour, and ultimately negatively impact their defence.
Having Radiata stuff incorporated into CISCO's products which are now sold in Canada adds a twist to this whole thing... but in my opinion any judge with a little inshight should be able to figure things out.
