The U.S. is playing with fire here - if they prevent Glencore from paying royalties to Gertler there is a chance he could win an asset freeze/seizure case in congolese courts.  If the US makes it too hard to do business in the Congo then the Chinese will step in and buy some of the world's most valuable copper/cobalt resources for bargain prices effectively sealing China's future as

Absolutely, which is why the US may have to hold its nose/turn a blind eye and let western firms operate like this in Africa if they want to keep the Chinese out of the picture.  If Glencore find it too risky to operate in the Congo with the DOJ on their backs and they sell KAT to the Chinese its game over for the west with regards to the battery/EV race.
