Mushaluk wins Supreme Court order against Stockhouse posters

Fission 3.0 Corp.'s former president, Jeffrey Mushaluk, has won an order in the Supreme Court of British Columbia directing Stockhouse Publishing Ltd. to provide identifying information for three forum users. The users were behind a series of messages that Mr. Mushaluk claims were false and defamatory. Among other things, the posts accused him of being a "smear campaign artist" who had a "plan to take down the fission management and take over."

The order, handed down on Thursday, Jan. 14, directs Stockhouse to hand over any identifying information that it has for the Stockhouse users who went by the aliases Enlightening, Himey2012 and Smittyh2000. Stockhouse must provide e-mail address and IP addresses for the three users. (IP addresses are unique identifiers that can usually be traced to a user's physical location, although such tracing may require a separate court order for the user's Internet provider.)

Thursday's order stems from a series of messages that began in March, 2020, shortly after Mr. Mushaluk's brief tenure as Fission 3.0's president. (Fission hired him on Sept. 18, 2019, but just months later the company said that he had left. A one-line news release dated Feb. 7, 2020, attributed his departure to "cost-reduction efforts.")

The forum messages, as set out in Mr. Mushaluk's Oct. 27, 2020, petition appeared in the months after he left Fission. One, dated July 1, 2020, called him a "man with a shady past" and a "cancerous human being," and claimed that he had some sort of plan to take over Fission. Other posts accused Mr. Mushaluk of making vulgar attacks on a Fission employee. Mr. Mushaluk said that there was no truth to any of the messages, and they were entirely defamatory.

If Thursday's order leads to Mr. Mushaluk obtaining the names of the users, he would then be in a position to file a lawsuit or (more likely) demand an apology. Vancouver lawyer Carey Veinotte of Whiltelaw Twining Law Corp. filed the petition on Mr. Mushaluk's behalf. Stockhouse did not oppose the matter.

@ GovernanceQP - Hey Turner.  Watch your mail for a legal sized envelope with the names of lots of lawyers on it.   As for a Yeelirrie permitting controversy in Australia, I'd say that except for CCO it's on the helpful side for companies with projects in Saskatchewan.

At least you get some psychological relief from posting here Greenday good for you. Yeelirrie and Kintyre (Cameco uranium assets in Australia) by all accounts are not all that high on Cameco's list of priorities so it has never really been a consideration for the current supply / demand debate. The Yeelirrie permitting issues if all is made known may involve something that is indirectly ...more

@ GovernanceQP - Hey Turner.  Speculation is that you posted as Enlightenment, Himey2012, and Smittyh2000.  You'll be the first to know if something is going on and at the least you'll need a lawyer if you did.
