Apple appeal bump tomorrow?

Tomorrow, WiLan lawyers will respond to the Apple appeal to the CAFC.  Also they ask for the original jury award of $0.85 / unit to be reinstated, which would double the $109M award to over $200M (and also covers only iPhone 6 and 7s).  And the total judgment could be $400-$600M if subsequents units included until the patents expire. 

There could be a bump as lawyers look at the strength of the arguments from WiLan.

Someone posted a few weeks back that Wilan had requested an extension until the 19th. Has that changed?

The Apple deal is still 1 to 2 years away. I would not put to much energy into it. If anything it would be great to see WiLAN sold in order to expand IRD. Smart Green Technology is where things are headed. WiLAN has over 20K in patents a little over a billion in value. Selling WIN for US$350-US$400M would be a fair value. IRD with its ITS solutions and Smart Traffic Light Technology will skyrocket ...more

Blackspade, from your response should I conclude you feel the Supreme Court will hear the case if Apple appeals? Or how do you estimate 2 years? Thanks.

Scott, no one who has followed Apple will be surprised if Apple appeals a CAFC judgement that is favorable to Quarterhill to the Supreme court. This is standard operating procedure for Apple to delay paying a patent licensing award as long as possible. Scott-  Blackspade has been held to account on this issue and is totally out to lunch on  this issue re timing/  He is assuming Apple case will be heard by Supreme Court.  Disregard his post. Astutein, there is nothing that prevents Apple from submitting in effect a nuisance appeal to the Supreme court. The question that I had last year when this question came up is whether a nuisance appeal could negatively impact future Apple Supreme court appeals. Do any of the legal pundits out there have an opinion?

100mill- I concur and agree with you that Apple can submit nuisance appeal but the point I am raising is the prospect of SCOTUS agreeing to hear the case.   Decision to hear appeal does not take long time frame .  IInterest expense still accruing. Love to get decision for Apple to appeal to SCOTUS.

Absolutely with out question Apple will exhaust all their possibilities when you have billions of dollars backing your defense. Apple has already set the precedent and will drag this out like they did to VirnetX in the first Apple case. WIN will get 7% interest added, which for Apple is chump change considering they made Billions off of Ken's 4G LTE patents and will only pay out maybe  ...more

Blackspade, I believe that the second Apple appeal of VirnetX's win is a separate case.  Without going back and precisely confirming the numbers, from memory, VirnetX has cashed the $600M+ check and is now awaiting a positive outcome in the $500M range from the second case...plus ongoing royalties. CAbbie - You are correct.  On March 13, 2020 Virnetx was paid 454,033/ On Nov2/2020 Virnetx Award of 502.8  Million in Separate case involving two network  patents. Apple could go down for over one billion when second case finished.

Yes VHCs first victory was for US$454M which Apple paid and now they are fighting it out over a second round of patents with Apple. It would make the most sense to unload WiLAN, like most i do not like Obama 2.0 in the patent play. QTRH should not have an issue to get $350-$400Mil US for all its patents. 2022 maybe 2023 will be WiLANs pay day.  Just look at the time line VHC had with Apple in the first case. Plus Obama 2.0 is now in play that could drage out a patent case even longer. Biden/Kamala took a lot of money from FAANG and pay back is coming. I like IRD and patents are great for companies in Europe and China that can use the courts like Qualcomm did to get a faster resolution from ...more

Wilander, Quarterhill will not get anywhere near fair value for Wilan until after the Apple CAFC case. Selling Wilan at this point would be foolish.

As others on here have stated 100mil.  Apple is a while off .  Even as much as two years at the longest.  And no, we wont get full value by selling now.  But it should be decent enough value with that Apple carrot low risk built in. I am now of the mind i would take the immediate SP rise and the instant chance to start turning IRD into a power NOW, rather than wait for two ...more
