IPA (Wilan) v. Microsoft

Most pre-trial motion have been ruled on by the court and the trial opens May 6th at 9:30 AM EDT in Delaware.

Motions' rulings on infringement were a mixed bag.  IPA lost the 115 patent but retained the 560 patent; it looks like there is still more than enough to press the infringement assertion.  However, IPA was a clear winner on damages, with the court refusing Microsoft's motions to deny alI IPA's damages experts and their reports.  Microsoft has filed a motion to reconsider, as a matter of law - stating that law does not support a damages calculation in excess of $200M.  Given the strength of the court's original order opinion on damage experts/reports, it is unlikely that Microsoft will succeed.  The court should rule on this early next week. 

Given QTRH's residual interest in Wilan and the potential size of damages (say nothing of 7 years of interest), this is an important catalyst to keep an eye on.

True Maxmoe.  $30M would look pretty good on the balance sheet. If Wilan is successful with Microsoft, Google will be next up.  The connectivity campaign is the other catalyst to keep an eye on.  Of course, QTRH never announced the terms of any earnouts, but we can safely assume revenue generated by Wilan is a prime metric.  And yes, I know with appeals, it could be years to

I wonder what trump will charge for presidential pardons? No way he gives them away, and they are going to fly. Maybe a long weekend at his hotel's "presidential suite" is enough? Seems like an appropriate bribe. He can take a bribe, issue a pardon, then pardon himself for taking the bribe. Neat little package.

The final Microsoft motion has been DENIED.  This motion sought to exclude reference to Siri's commercial success in Apple products, arguing that there was no connection between the asserted claims of the 560 patent and Siri.     It appears that the trial will open with Microsoft's motion for reconsideration on the court's damages ruling still in the briefing

Microsoft's Motion for Reconsideration to exclude Wilan's damages theory and Mr. Kennedy's expert report and testimony was DENIED.   Claimed damages are >USD$200M, plus 7 years interest.     The trial starts Monday.

QTRH has a 10% equity position and ~C$30M in earn outs. That's potentially significant. I smell the possibility of a settlement before the jury delivers it's verdict.  We should not forget that Google will be next up.
