New presentation with BB and important comment on Florence

At the 32 min mark BB says the following

"After that [the public comment period] the EPA started the process of responding to the public comments received and they have been doing that for not quite a year now. And we believe, based upon our discussions with them that that part of the process is now effectively finished."

Said that the UIC permit could not be issued without the Programmatic Agreement being in place.

Said that there is no specific commitment from the EPA about the timing, but that it is imminent and the company believes it will be issued in the next few weeks. 

He is basically saying the permit is now approved and they are just waiting for paperwork. Listen for yourself.  This last sentence is my interpretation.  Please let me know if you think it is fair.

EPA "responding to the public comments" -- The YouTube suggested that the EPA would disclose those responses at the time it issues the determination. How many negetive comments were there that EPA had to formulate responses to? What was each negative comment about?

at the 39 minute mark a question arises about the possibility that some environmentalists could challenge the permit and cause a delay even further. BB clarifies that following the issuance of the final permit, the EPA has a 30-45 day appeal window where objections to the permit could still be raised but only by parties who originally participated in the public comment period. I have gone through those.  The only one was by a coalition of the Sierra Club and other entities.  It was a long written objection.  You can find it at the EPA site. They complained that the test facility did not test thoroughly enough, that the mine will use too much water, that it needs more monitoring stations, and a few more things. The argument about too much water is silly.  ...more

That was a very large entity, with well thought out objections, with high priced lawyers signing. What are the odds of them getting an appeal?   I will guess 50%. Odds of winning??  10%. nf

It was basically cut and pasted from their opposition to Excelsior.  There was one place in the doc that they actually said Excelsior instead of Florence.   Has it been tested enough.  Definitiely. Can monitoring stations be added.  Easily.  Done. Does it use too much water.  No way. Any alternative will use more.  The mine has little likelihood of success. ...more

Appeals timeline for Excelsior: 6/22/18 receives permit with effecttive date of 8/1/18, 7/13/18 appeal filed, 8/5/18 all parties jointly stipulate dismissal of appeal, 8/6/18 30 day appeal period ended, 10/5/18 joint motion dismissing the Appeal acccepted, and EPA lifted the stay, thereby resulting in the UIC Permit becoming effective. https://www.excelsiormining.com/news/news-2018  ...more

Because Excelsior has had a history of production problems that Florence is not expected to have. The ore body fragmentation is different on their property and they learned it the hard way by not having the same testing results that Florence has proven will work.

If a troublesome project such as Excelsior's got approved, our more straight forward deposit should breeze through. True, their initial approval was under Trump, but they recently got permission under Biden without any opposing appeals for well stimlation which can involve techniques such as fracturizing and acidation. https://www.excelsiormining.com/news/news-2023 ...more

This was a different administration though.  I asked BB directly (on the phone) if he had any sense of all of there being political issues holding this up or in play and he said he did not. Believe what you want, that is what he said.

well jc , you are wrong again... the water use is signifigant in todays culture .. see florence would take the water out of the water cycle  whereas housing and ag do not.... i am sure a past issue of the economoist will explain this to you fish
