Alfresco and Open Text Reach Agreement to Settle Patent Dispute

T.OTEX

Alfresco Software today announced it has resolved its pending patent dispute with Open Text, SA. In June 2013, Open Text, SA, an offshore subsidiary of OpenText (NASDAQ: OTEX, TSX: OTC), filed a patent infringement suit against Alfresco, which was pending in the United States District Court for the Northern District of California, Case No, 3:13-cv-04843-JD. The case asserted that Alfresco infringed certain Open Text patents related to marketing techniques and work-space collaboration functionality. On September 19, 2014, the court dismissed the asserted claims of the marketing patents with prejudice after finding them invalid. The court did not address the remaining collaboration patents. Alfresco and Open Text now have settled the dispute regarding the remaining patents. The specific terms and conditions of the settlement agreement are confidential.

“Alfresco is pleased to have reached this settlement agreement with Open Text,” says Paul Warenski, Chief Legal Officer and General Counsel of Alfresco. “Although we continue to believe the case was entirely meritless, we are happy to have the expense and distraction behind us so we can focus exclusively on our rapid growth in the enterprise content market.”
