We may have our own opinions of Michael Dehn's performance but we don't know the specific reasons the company used to cut him loose so it's hard to comment on what justification he has for suing.  It is worth noting that the company didn't immediately cut him loose, they created an interim position for him which gave him time to look for another job while still having some kind of income coming in. I believe this went on for a few months. The fact that they did this should mean that even if he were to win his suit any damages might be severely limited by benefits already received.

In addition he had only been with the company less than a year so any entitlement is severely dimished by his limited seniority and contribution time. It's not like he had been with the company for 10 years and was then chucked out the window.

This whole thing is a non-issue.
