This deal has some problems
firstly to require this complex an agreement the lawyers make a bundle. Secondly it doesn't get this complicated unless they have something to hide. Thirdly, the debentures maturity is still 1 1/2 years away for one and three for the other. Fourthly would you invest in a firm where management has already proven their incompetence in spades? Fifthly, I believe this is a clear the air opportunity. Perhaps we can end up with a capable management group when this bunch leaves through vote or takeover. The problem here has never been the firm but a management team with no concern for investors whatsoever and still struggling to understand their firm's assets. I may add that there is no guarantee that if it failed went to bankruptcy that this group would get the assets. The asset would be sold into a competitive bid process with the winner paying the highest price.
