Go time?

We are still some time from the end game. One of the last steps is the tribunal asking for an update on costs incurred that would be included in the arbitration. We are not close until the tribunal makes this request which should be reported on their website. I believe March/April was the estimated time to conclude the arbitration and have a decision.

Jeez.... I thought that is where we were at a year ago - ICSID hearings wrapped up and expecting a decision by end of 2020.    Now that Minesa has to start from zero will that impact the ICSID decision? The original arbitration claim was $760M US - close to a Billion Cdn.   Will that have changed?

The news certainly implies Minesa is now out of it if the ICSID was hoping for a negotiated settlement. I understand the ICSID gives parties the ability to include their arbitration related costs costs before the final decision is rendered. The ICSID will contact the parties to submit those costs before making a decision. That is my understanding. The March date for the decision is looking more ...more

Thanks Oldtimer, When the ICSID contacts them to submit their final costs, will a news release be required on what that amount is?   Or will we hear about it only with the final decision?

Not sure what the ICSID would do about reporting the amount of additional costs, but EOM should announce the amount as they did with the original arbitration demand. I would hope the cost of lawyering up with our inflated arbitration staff would be included. Nice to recover those costs that come out of the the loans we are funding.
