III            Procedures and methodology used in the evaluation:
 
- Review of the judicial background provided by the expert.
- Review of the judicial background provided by the lawyer of the counterparty, Mr. Alvaro Vives, by email issued on July 07, 2023.
- Interviews conducted:
 
• Four forensic clinics interviews, with the aim of investigating the milestones of his development, life history, judicial situation and possible alterations in their psychic development.
• Analysis of the autobiographical narrative of the expert.
 
Instruments that accompany the evaluation process:
Application of the Minnesota Multiphasic Personality Inventory MMPI-2 test
- Reading and analysis of the background of the cause.
 
IV            General description of the case (described by the evaluated).
 
From the expert's account, it is known that the judicial situation originates from legal litigation about the mining property rights, which Mr. Jorge presents.
 
In this context, the evaluated realizes that he has maintained various trials over the last few years, where he has sought to demonstrate his territorial ownership of the deposits where the
Pascua Lama mine was designed and, likewise, to deny the statements made by the counterparty, in this case, Claro & Co.
 
In this scenario, the expert exposes the consequences he has experienced from the judicial situation, stating that in Chile, his family and labor stability is threatened. In addition to this, when residing in Canada, the situation has impacted in that country, from the workplace where he operates, noting that "the BCSC opens its case to arrest me in Canada for defrauding my client, they have left me suspended for life and fined for the assertions of FELIPE OSSA GUZMN and CLARO & CO., which I highlight with full knowledge of the Mining Legislation of Chile in force, in all its form and substance.  It does so only on the basis of the false and criminal AFFIDAVIT criminal of Felipe Ossa, first in private institutional civil form, abusing the POORLY EXECUTED private instrument.”
 
Likewise, the expert states that on "July 10, 2018, the Consulate of Chile in Vancouver, admits as legal defendant of my lawsuit Rol C 29407-2016 Peter J Brady of the BCSC, the employer of Felipe Ossa Guzmn and Claro & Co. PETER J BRADY principal affected of the contracting party of legal services, the institutional employer of FELIPE OSSA and CLARO & CO., denies that the case Rol C 29407-2016, where Peter J Brady had been accepted by the Consulate of Chile in Vancouver as a defendant of my lawsuit.  The day before, the BCSC had received my international exhortation authorized by the Supreme Court and delivered to the BCSC via the Ministry of Foreign Affairs of Chile, endorsed by the Canadian Embassy in Santiago de Chile, to Embassy of Chile in Ottawa who delivers it to GLOBAL AFFAIRS CANADA and after fighting against DAVID EBY expert lawyer (…) that rises to the provincial ceiling keeping my secret for the BCSC and public investor of Canada because FELIPE OSSA GUZMAN and CLARO & CO. say that what the Supreme Court has validated as requested and decided by national courts, against its employer DOES NOT EXIST ".
 
In these circumstances, Mr. Jorge delivers supporting documentation associated with the Technical Report of expert Catalina Albnez Vergara, Civil Engineer in Mines, Expert Surveyor in Mines, where he is aware of mining titles granted by the Conservator of Mines of Vallenar. That documentation is - for the evaluated - a fundamental piece to prove his innocence and account for his legal support.
 
In this line, Mr. Jorge exposes in an extensive way the change that he has experienced throughout his life trajectory by virtue of the damage caused by the judicial situation and the constant threats and hostile behaviors that he has perceived against him and his family by the counterparty.
 
V             OBSERVED BEHAVIOR:
 
Through the expert evaluation process, Mr. Jorge is recognized as a collaborator and participative, evidences flexibility about the evaluation schedules. Likewise, he shows interest in giving an account of his point of view in the face of the judicial situation he is experiencing.
 
In addition, he responds to the questions that are asked clearly, with security and conviction, constantly verbalizing the presence of supporting documentation, which it subsequently sends in order to corroborate the information he provides in the evaluation process.
 
As for his affections, an emotional break is seen when he verbalizes – from his point of view – the effects that the judicial situation would have generated on his family member and on his person, realizing a perception of constant threat towards him and his family context.
 
VI            SYNTHESIS OF THE PSYCHOLOGICAL EXPERT EVALUATION:
 
Through the evaluation process, it is recognized that the evaluated has a cognitive development according to his age range and socio-cultural situation. In this, a positive lexicon impresses that allows to know landscapes of his life history, identifying life experiences, family dynamics, social interactions and self-perception.
 
Likewise, from his story a personality structure is visualized in the line of the neurotic, where the evaluated evidences a logical / formal structure, existing capacity for organization and planning; which has allowed him to respond to the various circumstances of his life and professional career.
 
In the same way, it is identified by Mr. Jorge a sense and judgment of preserved reality, that is, he manages to identify between fantasy and reality, there are no indicators of alterations in the structure and / or content of thought, evidencing a formal thought, according to Piaget, where the expert manages to carry out an inductive and deductive analysis, with critical analysis and abstract capacity.
 
In this context, signs of psychosis or loss of judgment of reality are ruled out, since the evaluated evidences adequate logical reasoning.
 
As for the affective area, psycho-emotional alterations are recognized in the expert, which he identifies, but does not manage to problematize, that interfere with various areas of his personal life by being focused on the judicial situation and demonstrating an innocence in the face of the responsibilities assigned to him. Pointing out in this regard that "they are slanders, fallacies that have invented against me.  They have lied and defamed me." Faced with this behavior, an obstinate / willful behavior is perceived, which has led to the deterioration of his social and family relationships, because the evaluated has been focused – for a long period of time – on seeking – what he considers – the legal truth.
 
This situation has generated the presence of anxious/depressive symptoms, a constant perception of harm by their environment, hypervigilance, suspicion and distrust of their social context. In the process, he verbalizes fear for his physical integrity and that of his family. In addition, the evaluated is focused on restoring his moral value, which - he - recognizes damaged from the judicial situation, specifically by Mr. Felipe Ossa.
 
Following in this line, this judicial situation has interfered with him when it comes to maintaining stable affective relations with his family, specifically with his children and his ex-wife; whom he recognizes as one of the main victims of this situation, recounting the end of his marriage before the anguish and anxiety that he has evidenced since the judicial process.
 
Regarding the results investigated in the MMPI-2 Personality Test, the indicators of alterations in mood are corroborated, appreciating elements of depression and worry that account for an interference in the mental health of the evaluated, existing persecutory ideas and impaired perception of his personal resources, added to alterations in the sleep/wake cycle.
 
V             CONCLUSION
 
By virtue of the above, indicators of severe alterations in the mood are recognized that, from the investigation, have their origin in the judicial situation under investigation; where the evaluated shows a significant deterioration in their interpersonal relationships and, also, in their security and self-image, by observing themselves without personal resources to face the psycho-emotional consequences that has led to the legal litigation that maintains for a long period of time.
 
In this, it is realized that Mr. Jorge Lopehandia, evidences emotional damage characteristic of the judicial situation that he is currently going through, where negative and catastrophic thoughts have arisen regarding the perception that he has of his environment and the impact that it can generate in his personal security, which has interfered in their psychosocial development.
 
That is all I can report.
