Mr. Mamdani passed the 10% ownership threshold due to a reduction in outstanding shares via a normal course issuer bid. Pursuant to section 6.1(1) of National Instrument 61-103 (“NI 61-103”), he was exempt from the early warning reporting requirements as the threshold was reachedwithout any action being taken by him. Section 6.1(3) of NI 61-103 allows for this exemption to

remain in place until such time as the holder effects a transaction that changed his securityholding percentage. On September 16, 2008, Mr. Mamdani purchased 65,500 common shares on the open market.
