Olderwisernow's direction is the one that holds out the highest probability of success IMO. In otherwords, an in your face legal challenge or countervailing force is needed. It's what they understand. To do otherwise is to ask oneself am I  prepared ( forced ?) to accept  a share price offer that could very likely be not much different from current.
Don't be fooled by to-days price level / volume of trading or until if / when this deal hopes to close. The forces at play will want the share price to remain within range of the 38c pricing during this period.
