On one hand, we could have seen this coming, US doesn't like it when people publicly try and work around there rulings, so they definetly will go after Glencore ... pubicly. 

To be honest, I think this DOJ subpoena is a front... a ploy to make sure the US doesn't lose face publicly.  The Congoloese government and Gertler are corrupt as hell and they owned the mines back when Glencore was looking to buy.  And those asswipes, will kick you out if you don't play by there rules and is not like the money Glencore was suppose to pay in full to the mines was going to the benefit of the Congolese people.  The US might as well impose sanctions on the Chinese companies doing business in the Congo...

Glencore knew the risks of dealing with Gertler,  yet they still chose to pay the guy, because in there mind, he was a bigger risk than the "backlash" from the US...
