I think there is huge validity in zeus' comment:

"The main uncertainty now is the status of the dividend, and the main risk to that is whether or not the bank loaning Mart the $100 million would ask for a termination to the dividend as a requirement for issuing the loan proceeds."
 

It may not be their call..
