(“BioteQ”) was given notice of failure of the SART Plant to operate to the guaranteed performance standard as established by the TCRA.BioteQ failed to remedy the SART Plant deficiencies putting NWM in a position to terminate the lease to-own arrangement in the TCRA. NWM agreed to withhold terminating the lease-to-own arrangement in order to give BioteQ an opportunity to remedy the SART Plant deficiencies and to allow the parties an opportunity to discuss a revised payment schedule under the lease-to-own arrangement.To date, BioteQ has failed to remedy any of the SART Plant deficiencies and by initiating a claim, BioteQ has refused NWM’s offer to withhold terminating the lease resulting in the termination of the lease-to own arrangement for the SART Plant.
