Lansing, Michigan decision in the case of ANDARY v USAA CASUALTY INSURANCE COMPANY (December 2023)  -  that opined the 2019 reforms, by their terms, apply to medical expenses and services stemming from pre-reform accidents and that this is not a retroactive application.

 >> In determining whether a law has retroactive effect, four principles are considered. First, a court considers whether there is specific language providing for retroactive application. Second, in some situations, a statute is not regarded as operating retroactively merely because it relates to an antecedent event.
