The judge isn’t rushing to a decision. His schedule has both sides submitting written arguments in July and August.
 “In effect, it resets the clock to where we were last fall, when we were pushing for (a full study) and asking for consideration of route alternatives,” he said. “We’ll be doing that again.”
The tribes also are pushing for a review that includes public and tribal input.



Honestly, I think you are missing the point here. This mine does not cross under the river like the NDAPL does. The reason why the Army Corps of Engineers were involved specifically here is because the pipeline was granted easement under the river by the ACoE. The federal government actually owns the easement in that case.  That is not the case in this instance and the reservation for the Menominee is quite far from this location. Also the mine is completely in the state of Michigan and the state is the only jursdiction that has to be invovled here. As part of the review process of the state when permits are submitted, the state will also bring in the EPA or ACoE were needed to get a second opinion or agreement with their stance on certain issues. To date all of the reviewed permit points that have been sent to the EPA have been approved. Therefore the federal side of the house seems to be on board with the current plan and in approval of it.
