You are probably right if you rarely do it and do not claim a capital loss. However, according to my accountant if you regularly buy and sell within the 30 day limits, you capital gain might not be considered as capital gain by Revenu Canada but calculated as a regular revenu such as interest revenues.
Obviously, considering that this guy is charging me for his advices, he better be right. I am not about to ignore what he says unless I see something official to the contrary.
I would have then no issue challenging his advices if they are wrong.
