a) Kigoda signed the royalty agreement and accepted the $2 million payment.
b) The Tanzania government cancelled the ML and has agreed with Canaco regarding the compensation but Kigoda hasn't signed off so the money has been paid to a lawyers trust account.
If a) is the case then SOC doesn't have much of a chance in court.
A couple of leading questions that might point to b)
- where is Kigoda's royalty agreement? Isn't it odd that it wasn't uploaded to SEDAR along with the Denwill Mining royalty agreement at the time of the prospectus as a material contract?
- why did Kigoda only accept $2 million when obviously the property is worth much more than that
