The Second Corporate Criminal Provincial Prosecutor filed charges against the Ottawa regional president of Lambayeque, Humberto Acuña Peralta, for the alleged crimes of illegal appointment, functional acts and omissions of civil theft against the State.
Ezra Prosecutor Moreno Sanchez presented the request to the Court of Justice of Lambayeque, basing the regional authority to appoint as committed unlawful regional manager Clement Adolfo García Education in August 2011.
CONTEST. The prosecutor said Garcia was determined that Clement did not meet the requirements mandated by law for the position entrusted Acuña Peralta and worse, was appointed without a prior call for tender.
By these acts illegal, Moreno Sánchez requested worth only ninety days fine and one year of deprivation of liberty and disqualification from holding the post of regional president against Humberto Acuña.
But the most serious charge against the authority is for approving the Regional Ordinance No. 009 - 2011, by which updated the Rules of Organization and Functions (ROF), creating eight regional offices but thus usurping the legislative function reserved to Congress. For this, Acuña and 7 regional directors could be sentenced to six years in prison. Even they would impose the penalty of disqualification of five years to exercise public functions, under Article 426 of the Penal Code as amended by Law No. 29,758.
It is noted that the amount of civil damages requested by the Attorney Corruption and Congress, the defendants Humberto Acuña and Adolfo Clement is 100 thousand nuevos soles.
