The Cree obviously made their claims b/c of a dispute over adequate compensation.  Is there any evidence that the claim is vexatious - no (although I too have my reservations with CBC's lack of reporting all details).  Resolution of the dispute is achieved by negotiation, failing which litigation ... little is gained by ignoring their rights. 

As for the $90 million spent ... I sure hope that your response is not the opening statement in court to the environmental charges.  If HSE is responsible for the spill, it is responsible for the clean up costs.
