There is no complelling reason for lower courts to accept since Alaska's petition was based on State sovereignty as rejected by SCOTUS, not technical merits of the project.

If Alaska attempts to pivot and question EPA and USACEs' veto and permit rejection environmental basis the proponent's transparency will be in full display.

At some point, a Feasibility Study with all inclusive costs will be required to be prepared, possibly by the State or courts, though highly unusual.

Expect the USACE to release a statement regarding 404 permit denial.
