It will have to be a new path.  SCOTUS rejected. The petition was based on State sovereignty which does not apply to Federal Environmental Law.  The State is not stupid enough (?) to take-on federal law, the EPA and the USACE based on projected project environmental impacts and demonstrated reserve-level economics.

All this decision means is that we will take the more traditional route and file first in the federal district court. This is correct. While I didn't want to miss a rocket ride, in @.36 usd and out @ .33 doesn't hurt. I'll likely be back in later. It's going to be a while. However, in the interim ...attentions are elsewhere.
