MN SC ruling came out mixed .
IMO the bottom line is back to DNR for a minor item and a huge item.
"Under a substantial-evidence standard, we conclude that a contested
case hearing is required on the effectiveness of the proposed bentonite amendment for
PolyMet’s proposed tailings basin."
"We further conclude that the court of appeals was correct in reversing the
decision to grant the permit to mine because the DNR erred by issuing the permit without
an appropriate fixed term. "
So these are the two line items that will send this back to DNR for more hearings.
Not sure - but this looks like another year or two of delay.
The good news is the other line items that would make them go back and start from scratch were tossed out.
