After losing what was supposed to be a slam-dunk infringement case, WiLAN knows Apple's defense was based on smoke & mirrors, and Apple knows it wouldn't fly in front of a panel of Judges in an Appeals court.  
So why not use the threat of an appeal to bring Apple back to the negotiating table? ie Give Apple the option of either buying a full package license agreement now - OR - face the very real prospect of paying up to $1 Billion in damages & fines for wilfull infringement when the appeal verdict comes in a year or so from now - in addition to a license agreement.

That's the strategy WiLAN should be pursuing to bring Apple into the fold sooner than later.

But a Billion dollar judgement from an appeal judgement sure is enticing..
