the cobalt received from the swap is to cover the receivables from Energas and is not the same as the dividend distributions from the JV where the partners get equal share. The Cubans need to make money too so when there is cash in the JV the partners decide how much to distribute. Any distributions that would have been made had there been no swap would be the same. The swap is additional to what thes normal distributions will be. If you follow the statements The JV partners will get equal dividends, but Sherritt will get an additional distribution via the swap. Therefore it's not a 50/50 split anymore while the swap is in place.

Sherritts share of the distributions from the JV will be about 16% greater than what goes to the Cubans.
