Thank you for your inquiry to the Ontario Securities Commission (OSC) concerning Sino-Forest Corporation (Sino-Forest).
As noted in our email of April 18, 2012 we understand that you believe the OSC did not fulfil its regulatory obligations. In our response dated April 9, 2012 we provided you with information about our actions and those of the Investment Industry Regulatory Organization of Canada's (IIROC) in this matter. We appreciate your desire to understand why the OSC took the position it did, and has made the allegations it has.
Evidence supporting Enforcement's allegations generally becomes available during the course of a proceeding, and becomes publicly available on the OSC website. As with other regulatory or enforcement agencies, the OSC endeavours to release information to the fullest extent possible. However; when a review or investigation or a proceeding is being conducted, OSC staff do not generally comment publicly, nor to individuals about its status or progress.
We understand that you may find it frustrating that staff may not comment further. We hope you can appreciate that the purposes of this policy are, among others, to protect the integrity of investigations and proceedings and to ensure the complaint process is not used to affect the market.
