The Congress has already received the preliminary hearing against President Jimmy Morales, as confirmed by the authorities of the Legislative Directorate.

Morales is appointed by the Public Prosecutor's Office and the International Commission Against Impunity (CICIG) for the crime of illicit electoral financing.

The topic, which will be known at the Board meeting on Monday, August 27, could be read in the plenary session on Tuesday.

The next step will be to integrate the investigating commission, which consists of five deputies chosen at random. The decision of the commission to withdraw or not the immunity will have to be supported with 105 votes.

The case

Morales, in his capacity as General Secretary of FCN-Nacin,  did not report to the Supreme Electoral Tribunal (TSE) the contribution of resources directly destined to the payment of  electoral prosecutors and the printing of electoral material, CICIG details.

The authorities explained that the prosecutors participated in their representation on September 6 and October 25, 2015, during the first and second round of the elections that same year, thus constituting anonymous financing.

According to the preliminary investigation of the Office of the Prosecutor against Electoral Crimes, the amount of anonymous financing amounts to a total of Q7,920,375.70 not reported to the TSE.

The forces in Congress

The Bank of the National Convergence Front (FCN-Nacin) has 37 deputies. The second force in the Congress is the National Unity of Hope (UNE) with 29 deputies.

The bench ALL adds 16 members and the Reform Movement 13. The position adopted by these groups will decide on the immunity of the president.
